Illinois Cannabis Possession Limits

Illinois uses a unique dual-limit system: residents can possess 30g of flower, 5g of concentrate, and 500mg of THC in edibles — while non-residents receive exactly half. Medical patients get 2.5 ounces per 14-day period. All three categories are cumulative.

Resident Possession Limits (Illinois ID)

Under 410 ILCS 705, Illinois residents 21 and older may possess the following amounts:

Non-Resident Possession Limits

Illinois is one of the few states that imposes different limits based on residency. Visitors receive exactly half the resident limits:

How Residency Is Determined

A valid Illinois driver's license or state ID establishes residency. Out-of-state IDs, passports, and military IDs are treated as non-resident. There is no minimum duration of residency required — a newly issued Illinois ID qualifies for the full resident limits.

Cumulative Categories

Illinois treats flower, concentrate, and edibles as separate, cumulative categories. This means you can legally possess all three at the same time, up to each category's limit. For example, a resident could legally carry:

  • 30g of flower AND
  • 5g of concentrate AND
  • 500mg of THC edibles

This is more permissive than states with a single unified weight limit. Each category is tracked independently at the dispensary point of sale through the state's BioTrack seed-to-sale system.

Medical Patient Limits

Registered medical cannabis patients under the Compassionate Use of Medical Cannabis Act have significantly higher limits:

Standard patient 2.5 ounces (approximately 71 grams) per 14-day period
Purchase tracking Tracked via the IDPH patient registry and BioTrack system
Qualifying conditions 40+ conditions including opioid alternative patients
Home growing Medical patients ONLY — up to 5 plants over 5 inches

Medical patients can also possess their home-grown cannabis in addition to dispensary purchases, though the home-grown cannabis cannot be gifted to others.

Gifting Rules

Adults 21 and older may gift cannabis to other adults 21+, subject to these rules:

  • Private and non-commercial: No money, goods, services, or anything of value may be exchanged
  • Amounts: Up to the possession limits for the recipient's residency status
  • Home-grown medical cannabis cannot be gifted — only dispensary-purchased cannabis
  • Location: Must be in a private setting, not in public view

What Happens If You Exceed Limits?

Exceeding Illinois possession limits is governed by the Cannabis Control Act (720 ILCS 550). The severity depends on the amount over the legal limit:

  • 30–100g (residents) or 15–100g (non-residents): Civil penalty, $100–$200 fine
  • 100–500g: Class 4 felony (1–3 years, up to $25,000 fine)
  • 500–2,000g: Class 3 felony (2–5 years, up to $50,000 fine)
  • 2,000–5,000g: Class 2 felony (3–7 years, up to $100,000 fine)
  • Over 5,000g: Class 1 felony (4–15 years, up to $150,000 fine)
